NOTICE OF CLAIMS PROCESS FOR RAS-CON GROUP INC. (the “Applicant”) IN THE APPLICANT’S RECEIVERSHIP PROCEEDING

PLEASE TAKE NOTICE that this notice is being published pursuant to an order of the Superior Court of Justice of Ontario (the “Court”) dated December 16, 2021 (the “Order”) establishing a process for determining the amounts of construction trust claims against the Applicant pursuant to the Construction Act, RSO 1990, c C.30 (each, a “Trust Claim”). The Court has ordered that the Receiver send Proof of Claim forms to certain creditors of the Applicant. Any person who has not received a Proof of Claim form and who believes that they have a Trust Claim against the Applicant, which claim arose prior to December 16, 2021, should send a completed Proof of Claim to the Receiver to be received by no later than 5:00 p.m. (Toronto time) on March 24, 2022 (the “Claims Bar Date”).

TRUST CLAIMS WHICH ARE NOT RECEIVED BY THE RECEIVER BY THE CLAIMS BAR DATE WILL BE BARRED AND EXTINGUISHED FOREVER.

Creditors who have not received a Proof of Claim may obtain a Proof of Claims package from BDO Canada Limited, the Court-appointed Receiver of the Applicant, by contacting Michael Litwack (ml******@*do.ca).

Earlier, he worked as a journalist and sub-editor, including a stint on the Bulawayo Chronicle in 1979-80, during the transition from Rhodesia to Zimbabwe.  He has lived in Ottawa since 1981.
