OLT mediation settlement reached on proposed CAIVAN subdivision in Perth

A settlement has been reached through an Ontario Land Tribunal (OLT)–led mediation process related to a proposed subdivision by CAIVAN (Perth GC) Limited, bringing a major planning dispute closer to resolution.

The settlement follows a series of mediation sessions held throughout the year under Case Number OLT-23000534. The sessions brought together representatives from the Town of Perth, the County of Lanark, CAIVAN, legal counsel, expert witnesses, and a Tribunal-appointed mediator.

According to the town, mediation meetings were held on Feb. 14, March 16, April 30, May 30, Aug. 19, Sept. 23 and Oct. 23. The process allowed all parties to exchange information, clarify technical and planning issues, and work through areas of agreement and disagreement under the guidance of the OLT mediator.

With mediation concluded, the matter now moves into the formal settlement approval stage of the Tribunal process. Legal counsel for the parties are currently drafting the Minutes of Settlement, which will then be reviewed and signed by the Town of Perth, Lanark County, and CAIVAN.

Once approved, the Minutes of Settlement will be posted publicly, and a public meeting will be held to present the settlement details and provide an opportunity for interested parties to learn more. The Town says the public meeting could take place as early as January 2026, with the date and location to be confirmed.

Participants in the OLT process will also have the opportunity to update or withdraw their previous submissions, in accordance with timelines and procedures set by the Tribunal. An OLT hearing will then be scheduled to review the Minutes of Settlement and participant statements, after which the Tribunal will render a final decision. The hearing date has not yet been determined.

The Town of Perth acknowledged that residents and stakeholders have been closely following the proposed subdivision and associated OLT proceedings. While information shared to date has been limited due to the active Tribunal process, the Town said it remains committed to transparency.

Once the Minutes of Settlement are finalized and approved, full details will be made available on the Town’s engagement website and presented at the public meeting.

For Ontario’s construction and development sector, the settlement marks an important step toward regulatory certainty on the proposed CAIVAN project, pending final approval by the Ontario Land Tribunal.
